Complex Construction Claims

In 2001, Gulsby-Bay Plant Partners was engineering and constructing two gas processing plants for Gulf Liquids New River Project LLC in Louisiana. Gulf Liquids stopped payments to Gulsby-Bay, terminated the two EPC contracts with Gulsby-Bay, and made demands upon Gulsby-Bay’s performance bond surety.

Andrews Myers represented Gulsby-Bay throughout five years of a multi-party lawsuit in which Gulsby-Bay asserted substantial claims against Gulf Liquids and other parties. Other parties aligned with our client similarly raised substantial contract and tort claims against Gulf Liquids arising out of two related processing plant projects, including one of the Gulsby-Bay’s joint venturers, Gulsby Engineering, Inc.

Gulf Liquids asserted a counterclaim against Gulsby-Bay and its joint venturers seeking damages in excess of $50 million under contract and tort theories.

After a four month jury trial, Gulsby-Bay was awarded all of its compensatory damages and significant punitive damages. The jury denied Gulf Liquids’ counterclaim.

Along with the favorable jury award to the other parties aligned with our client, the total jury award was the second largest jury verdict in the United States in 2006.

Gulsby-Bay settled on a confidential basis during the pendency of the appeal.
