Solar Farm Warranty Claim

Andrews Myers represented a significant warranty dispute arising from the The Project in Maryland. The 20-acre solar farm, developed as part of a Maryland Public Service Commission initiative to expand access to clean solar energy for low and moderate income residents, features approximately 22,000 First Solar frameless modules mounted on an RBI Solar tracker racking system.

Following the discovery of structural and mechanical failures in the solar farm’s racking system, CS Energy and Vitol, under a joint prosecution agreement, are pursuing a warranty claim against RBI Solar—the only turn-key solar racking company in the United States. The damages sought exceed $5 million, reflecting the scale and impact of the alleged failures on the project’s performance and reliability.
