James “JG” Albertine’s practice is devoted to construction and general business litigation matters. He is a litigator and trial lawyer whose practice focuses on the trial and dispute resolution of construction law disputes including breach of contract, mechanic’s liens, payment bonds, performance bonds, collections and creditor’s rights, fraud, construction defect claims, termination of contracts, differing site conditions, bid protests, schedule compression, acceleration and jobsite personal injuries. His business litigation experience includes matters related to insurance defense, insurance coverage, toxic tort, defense of motor carriers, banking and environmental law.

Prior to joining the firm, JG was a partner in a New Orleans law firm and member of the firm’s general civil litigation practice group where he gleaned experience in matters related to construction litigation, insurance defense, professional liability, asbestos, and personal injury. Prior to law school, J.G. worked in both the construction industry as a construction manager for a residential construction company in Memphis, TN, and the oil and gas industry as a landman in Shreveport, LA.

Representative Experience

  • Experienced trial attorney in multiple bench and jury trials, including conducting jury selection, arguing Pre- Trial motions, direct and cross examination of both expert and fact witnesses, arguing of Post-Trial motions, drafting Post-Trial memoranda and appellate briefing
  • Represented steel subcontractor defendant in a consolidated matter of over 100 lawsuits arising from the 18-story collapse of Hard Rock Hotel in downtown New Orleans
  • Managed and handled Mass Hurricane Katrina Nursing Home Litigation involving approximately 75 separate wrongful death lawsuits arising from General Negligence Claims, including filing of responsive pleadings, propounding of complex discovery, conducting depositions throughout the country, arguing Pre-Trial motions, participating in two-week jury trial, drafting Post-Trial motions, drafting of appellate briefs to the Louisiana 4th Circuit Court of Appeal and eventually managing global settlement of all cases
  • Obtained payment for various subcontractors pursuing lien claims and payment claims on both private works projects and public works projects
  • Obtained collection judgments on behalf of national geotechnical engineering firm
  • Represented architect in litigation concerning alleged extensive water intrusion from failed roofing system in a church
  • Represented steel subcontractor in litigation concerning extensive water intrusion from alleged failure of roof, mechanical, balcony and concrete systems in new construction of 209-unit apartment development
  • Represented architect in litigation concerning failed mechanical sprinkler system across 8-story luxury condominium complex
  • Represented architect in litigation concerning failed roofing and roof pool system in luxury condominium building
  • Represented mechanical engineer in alleged HVAC systems failure across sixty-one units in downtown condominium complex
  • Defended wrongful death lawsuit allegedly arising out of the design and construction of commercial parking lot
  • Defended building collapse lawsuit allegedly arising out of negligent design and construction of expansive addition to historic Saenger Theatre in downtown New Orleans
  • Assisted civil engineer on extensive pre-litigation claims throughout the course of public works construction projects on delay claims, defect claims, termination and default notices and other matters arising on large public works drainage projects in South Louisiana
  • Assisted structural steel engineer in resolution of public works high school project over alleged footing capacity/settlement issues during the course of the project with owner, architect and general contractor in Mississippi
  • Represented civil engineer for alleged overflow and pollution of neighboring property on public works high school construction project
  • Represented architect in alleged failure to obtain historic tax credits for failed hotel development
  • Assist architect in recommendations to school board owner on multiple delay claims asserted during the course of construction of public elementary school
  • Defended alleged negligent design and construction of grocery store resulting in settlement into riverbed behind grocery store location
  • Defended subcontractor in OSHA investigation after being cited by OSHA for safety violations during the construction of downtown hotel
  • Represented developer in alleged water intrusion issues on mixed use condominium/hotel development in downtown New Orleans
  • Defended project engineer in failed neighborhood development for failure to obtain necessary permitting and flood elevation in Mississippi
  • Defended multiple wrongful death, traumatic brain injury, catastrophic job site injuries and complex personal injury lawsuits
