As of November 1, 2023, employers must use the latest version of Form I-9. This new form has been available since August, but became mandatory for all employers to use for any new hires since the beginning of this month. Link- https://www.uscis.gov/i-9
While the changes are cosmetic in nature, the new Form I-9 does not make any substantive changes to employer or employee obligations involved in the verification of work authorization. It is important to note that employers can still be fined for using an old version of the Form I-9 after November 1, 2023.
