The Consumer Financial Protection Bureau released an updated "Summary of Your Rights Under the Fair Credit Reporting Act" notice. Notices must be provided to applicants and employees before conducting background checks and when taking an adverse employment action as a result of a background check under the Fair Credit Reporting Act (FCRA). Employers should start using this revised notice as soon as possible, but no later than March 20, 2024.

Even though the changes are minor, courts have found employers liable for minor deviations from previous versions of the notice requirements.

The latest version of the notice is available here in English and Spanish.
