Partnership Dispute Case Win

The Firm represented a Class B limited partner in prosecuting breach of fiduciary duty claims against the general partner and the Class A limited partner of a regional shopping center development company.  Our client claimed that the general partner, under the control of the Class A limited partner, improperly allocated distributions of partnership profit to the benefit of the Class A limited partner.  The Defendants removed the case to Texas Business Court, and after Plaintiff challenged the removal, the Business Court remanded the case back to District Court.  Defendants then sought emergency mandamus relief from the Fifteenth Court of Appeals, which unanimously denied Defendant's petition and ruled that Business Court jurisdiction did not attach to the lawsuit.  Defendants then filed a petition for writ of mandamus and motion for emergency temporary relief with the Supreme Court of Texas.  After Defendants' petition was denied, our client obtained a successful settlement.
