Experience

  • Represents a national technology infrastructure integrator in a complex construction and technology dispute with a subcontractor on a large project for a Fortune 500 corporate owner. The client delivers integrated technology solutions, including audio visual systems, structured cabling, in-building wireless coverage, integrated security, network infrastructure, and data center and mission-critical systems. The dispute centers on schedule delays and their effects on the project, along with disputed change orders. Because these technology systems overlap with each other and with the wider construction schedule, the matter requires detailed analysis of project sequencing, scope, and contract obligations.
  • The firm's representation draws on its experience with construction and technology disputes to protect the client's commercial interests and its key project relationships.
  • Represented the owner of a newly built, roughly 146,000-square-foot, 40 MW Texas data center in disputes with its design-builder under a guaranteed-maximum-price (GMP) design-build agreement worth more than $400 million. The disputes involve competing claims over missed milestones, liquidated damages, contested and unpriced change orders, withheld payments, and delays tied to commissioning and equipment. Our work includes advising on the owner's change directive that narrowed the design-builder's scope and the takeover of key subcontracts, and the design-builder's delay claims.
  • Represents an electrical material supplier and distributor in litigation related to the construction and completion of a Data Center project in Vega, TX near Amarillo. The supplier filed a Mechanic’s and Materialman’s Lien on the project, owned by a corporate subsidiary of a major North American energy infrastructure and Bitcoin mining firm, due to non-payment of supplied electrical materials to the utility contractor, in order to secure payment of its debt.
  • Represented a national electrical infrastructure contractor on a $22.1 million turnkey EPC substation project supporting a hyperscale data center campus.
  • Represented a mechanical and plumbing contractor on a $97.8 million design-build fit-out of a hyperscale data center campus in Central Texas, including delegated design, BIM/VDC coordination, and procurement of critical long-lead mechanical equipment.
  • Represented an industrial insulation contractor on an $87.5 million thermal insulation package for a four-building hyperscale data center development in West Texas.
  • Represented a turbine field services provider on installation, overhaul, and commissioning arrangements for power generation assets serving a large-scale AI data center campus.
