Colby Binford’s practice focuses on construction law, litigation, and alternative dispute resolution. He represents general contractors, subcontractors, and small and mid-sized companies in a variety of construction and business related disputes. Colby represents a wide group of clients across several industries, including real estate development, property management, construction and design. Colby serves as outside general counsel for multiple property management companies. He has represented clients in over 200 bench trials, multiple jury trials, and several arbitrations in the course of his career.

 

Prior to joining Andrews Myers, Colby practiced commercial and real estate litigation with a boutique business litigation firm in Houston, Texas. He also served as a judicial intern to the Honorable Larry Weiman in the 80th Civil District Court.

  • Obtained a Rule 12(b)(6) Motion to Dismiss in favor of a national property management company in the Southern District of Texas.
  • Successfully represented owners and national property management companies in multiple complaints with U.S. Department of Housing and Urban Development, the Texas Workforce Commission and the City of Fort Worth Fair Housing Department.
  • Successfully defended a wrongful death case in favor of a national property management company.
  • Defended Fortune 500 property management in personal injury claims.
  • Defended national electric company in personal injury claims.
  • Represented numerous general contractors, subcontractors and suppliers in collection claims with Chapter 28 and foreclosure of mechanic’s and materialman’s liens.
  • Represented numerous national property management companies with vendor disputes in both federal and state courts.
  • Successfully represented an individual in the Southern District of Texas on Fair Credit Reporting Act and Fair Debt Collection Practices Act claims.
  • Defended national owners and property management companies in numerous residential and commercial lawsuits involving breach of contract allegations, business related tort claims, DTPA claims and discrimination claims.
  • Defended several property management companies and real estate developers in state court for environmental crimes.
  • Represented numerous Original Equipment Manufacturers in breach of contract and collection claims.
