Lance Lackey provides representation to clients in a variety of commercial litigation matters, including contract disputes, business torts, partnership and corporate disputes, breach of fiduciary duty, real estate and property disputes, fraud and unfair competition and theft of trade secrets. His practice further encompasses a broad range of administrative and regulatory disputes.

His commercial real estate clients have included developers, joint ventures, private equity investors, landlords/tenants and lenders. In addition to his real estate litigation experience, Lance has experience in all aspects of transactional matters, including entity formation, property acquisition/disposition, land use, development agreements, easements, and zoning and environmental considerations for mixed-use, commercial and industrial projects.

Lance’s experience includes both jury and bench trials in state and federal courts, as well as contested proceedings before the State Office of Administrative Hearings.

Prior to joining the firm’s Austin office, Lance was the co-founding member of a Texas-based, boutique law firm with a focus on individuals and business entities engaged in real estate, business transactions, litigation, sports and entertainment, and other business activities.

  • Represented one of the world’s largest specialty chemical companies in connection with a claim for theft of trade secrets against another chemical company
  • Represented one of the world’s largest mobile communications companies in national mass tort and consumer class action litigation
  • Defended an Internet-based market research firm against claims of false advertising and Lanham Act violations
  • Counseled a communication software provider in a nationally publicized lawsuit involving claims for copyright infringement
  • Represented a foreign manufacturer of systems and equipment for the chemical and pharmaceutical industries in defense of a national class action involving personal injury, product liability and civil conspiracy claims
  • Represented the nation’s largest office products retailer in administrative proceedings and a national class action involving “junk fax” claims under the Telephone Consumer Protection Act
  • Represented a national manufacturer, marketer and distributor of soft drink beverages in an injunctive matter against its primary competitor
  • Represented a regional communications company in a dispute over a corporate acquisition
  • Defended a large telecommunications company in a national consumer class action suit involving claims for breach of warranty and deceptive trade practices
