Employment Attorney - Ved Chitale

Ved Chitale regularly advises individuals and businesses of all sizes on labor and employment laws including FLSA, ADA, ADEA, Title VII, ERISA, Texas Uniform Trade Secrets Act, Texas law on non-compete and non-solicit covenants, and more, such as the Pay Day Act, employment torts, and wrongful termination. Ved has experience investigating charges, complaints, drafting employment policies, drafting employment agreements which include confidentiality clauses, non-competes, non-solicits, and counseling clients on all these issues.

Ved has experience representing employers in both federal and state courts. Ved counsels employers with an eye towards avoiding unnecessary litigation because he uses his experience and knowledge to anticipate issues before they become a problem and mitigate their impact in an efficient and effective manner. When litigation is needed, Ved handles employment discrimination, trade secret, non-compete, wage and hour, and ERISA cases and has experience with various government agencies including the Department of Labor, the TWC, and the EEOC.

Prior to joining the firm, Ved practiced employment, appellate, civil rights, and commercial litigation with both plaintiff’s and defense firms. In law school, he served as a judicial intern for the Texas First Court of Appeals and gained valuable experience with the Texas Attorney General’s office.

Ved is fluent in Hindi and Marathi.

  • Litigated wage and hour class actions, collective actions and hybrid class/collective cases for a national plaintiff’s firm through all phases of litigation: pleadings, motions, discovery, research, summary judgment practice, dispute resolution
  • Drafted appellate briefs in class and collective action cases in the Ninth Circuit and Sixth Circuit Court of Appeals
  • Obtained nationwide conditional certification for over 3,000 security guards who were not paid for all work performed for largest security firm in the Detroit metropolitan area
  • Won Motion to Reconsider Denial of Collective Treatment in the United States District Court for the Eastern District of Texas under the new legal standard in the Fifth Circuit for notice to putative Opt-In Plaintiffs under the FLSA
  • Defended small to mid-sized companies and international corporations in FLSA, Title VII, ADEA, ADA, ERISA and trade secret matters
  • Won final judgments on three Rule 52 Motions on the Administrative Record in ERISA cases in the Southern District of Texas
  • Co-wrote winning dispositive summary judgment motion in the Western District of Texas District Court in an ADEA case on behalf of major airline company
  • Defeated proposed nationwide Title VII sex discrimination and sex harassment class action in Southern District of Texas District Court on behalf of one of the country’s largest agricultural equipment dealerships
  • Defended a medical spa facility against wage and hour claims from former employees
